£480million to be reclaimed by those in financial hardship

People living in hardship and trying to reclaim their bank charges could still claim a collective £480million!

Those in financial hardship can still claim, even in the light of last November's Supreme Court decision in which it ruled that the scale of bank charges could not be challenged as unfair under consumer contract rules.

However, more recently a UK consumer has won the right to challenge the Bank of Scotland's overdraft charges under the Consumer Credit Act.

The bank will now have to demonstrate that its charges are not excessive.

The case will now go to a full trial on 11 June.
